The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has received multiple complaints from homebuyers regarding real estate promoters offering conditional possession of units. According to the complaints, promoters are coercing allottees to sign new agreements or declarations that differ from the original sale agreement, restricting their legal rights in the future.
UP-RERA Chairman Sanjay Bhoosreddy stated that the authority is preparing to take action against such promoters, ensuring the protection of homebuyers’ rights. He emphasized that units should be sold only based on approved plans, and possession must be granted without deviations from the agreed terms.
Complaints reveal that some promoters are offering possession without completing necessary amenities and facilities as per the agreement or without obtaining the required Occupancy Certificate (OC) or Completion Certificate (CC). Moreover, demands exceeding the unit’s cost and outside the sale agreement’s conditions have been raised by promoters before delivering possession.
UP-RERA is set to investigate these issues and take necessary steps to hold promoters accountable for misleading sales and forcing allottees into unfair contracts.
