Gurugram DM: Residents should vacate Chintels Paradiso

Gurugram District Magistrate Nishant Kumar Yadav ordered the residents of Tower J of Chintels Paradiso society in Sector 109 to vacate their flats within 15 days, citing an IIT audit report that declared the flats "unsafe." The orders were issued by Yadav, who is also the Deputy Commissioner, under Section 163 of the Indian Civil Defence Code, according to an official release.

The structure audit report from IIT-Delhi, released on January 5, had deemed Tower J of Chintels Paradiso Group Housing Society "unsafe for habitation." Consequently, residents must vacate the tower within 15 days of the DM's order and hand over vacant possession to the builder. Tower J is one of six towers in the society identified as unsafe in the audit report. The remaining five towers?D, E, F, G, and H?were vacated following an order from DM Yadav in April, which permitted their demolition.

Due to the imminent danger to life and property for Tower J residents, the DM issued the order under Section 163 of the Indian Civil Defence Code, in conjunction with Section 34 of the Disaster Management Act. The statement also mentioned that police assistance could be utilised to enforce the order.

The matter of compensation payment by the developer, M/s Chintels India Pvt. Ltd., to the residents and flat owners is being handled separately by the SIT constituted for this case. M/s Chintels India Private Limited has been instructed to settle all claims from Tower J allottees in a timely manner. Any individual found guilty of disobeying the orders will face action under Section 223 of the Indian Justice Code, Sections 51 to 60 of the Disaster Management Act, and other applicable legal provisions.

It is noted that six floors of Tower D in Chintels Paradiso society partially collapsed on February 10, 2022, resulting in the deaths of two women. Since then, a dispute has been ongoing between the builder and the residents.
