Telangana HC Orders Land Survey to Settle Patelguda Villa Dispute
In a partial relief to the owners of villas at Patelguda in Ameenpur municipality, which were demolished by the Hyderabad Disaster Response and Asset Monitoring and Protection Agency (HYDRAA) two months ago, the Telangana High Court directed the Assistant Director of Survey and Land Records of Sangareddy district to survey the land located at survey numbers 6 and 12 of Patelguda.
The court also ordered that the status quo be maintained on the disputed land until the completion of the survey.
The state had previously claimed that only houses constructed on plots in survey number 12, which is government land, were demolished. The survey is expected to verify the state's claim.
At the same time, the survey will determine whether the demolished villas were part of survey number 6, as the owners have asserted.
Justice CV Bhaskar Reddy stated that if the survey and localization of records revealed that the demolished structures were located on private land in survey number 6, the plot owners would have the right to seek compensation from the state. On the other hand, if the plots were found to be part of survey number 12, which is government land, the owners could apply for regularization of the plots.
The petitioners may apply for regularization according to the relevant government circulars and orders, should the land be found to belong to survey number 12. Authorities were instructed to review these applications and issue appropriate orders, considering the sale deeds executed in favour of the petitioners, as stated by the judge in his ruling.
While the petitioners' counsel, R Chandrasekhar Reddy, questioned the authorities' decision to demolish structures in Patelguda, which had been built after obtaining all necessary permissions, the revenue department's counsel, Muralidhar Reddy, argued that the petitioners were attempting to take advantage of the proximity of survey number 12 to survey number 6.
