Delhi Court denies cancellation of LOC of ATS Infrastructure promoter
A Delhi court has declined to cancel the lookout circular (LOC) issued against ATS Infrastructure Limited’s promoter, Geetamber Anand, and his wife, Poonam Anand. The LOC is tied to multiple FIRs, including those filed by the Economic Offences Wing (EOW) of Delhi Police for allegedly defrauding homebuyers, and a money laundering case initiated by the Enforcement Directorate.
Judicial Magistrate Yashdeep Chahal, in an order dated September 13, acknowledged that the accused had cooperated with the investigation but emphasized that the LOC serves as a precautionary measure to ensure the judicial process is not undermined.
The judge noted that requiring court permission for overseas travel would not guarantee compliance, as the accused could travel without such authorisation, leaving the court without any practical means to enforce the restriction.
"While personal liberty is important, reasonable restrictions can be imposed on the right to life and liberty under due legal procedures," the judge stated, concluding that there was insufficient reason to revoke the LOC.
However, the judge stressed that authorities must inform individuals of the reasons for preventing their travel. "It is the fundamental right of the accused to be aware of why their travel is being restricted," he remarked.
